ACCEPTANCE OF TERMSThese Terms of Use ("Terms") govern your access to and participation in Adult Field Day, including but not limited to the use of TodayIsFieldDay.com (the "Website"), registration for the event ("Event"), and attendance at any activities organized by Adult Field Day, LLC ("Company," "we," "us," "our").By purchasing a ticket, accessing the Website, or attending an Event, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any additional policies, disclaimers, or legal notices that may be presented to you in connection with the Event. Your participation in Adult Field Day is contingent upon compliance with these Terms. If you do not agree to these Terms, you must immediately discontinue your use of the Website and not attend the Event.These Terms constitute a legally binding agreement between you ("User," "Attendee," "Participant") and Adult Field Day, LLC. This agreement governs your rights and obligations related to your participation in the Event, including but not limited to liability waivers, safety requirements, payment obligations, conduct expectations, dispute resolution, and any other conditions outlined herein.We reserve the right to amend, modify, or update these Terms at any time, at our sole discretion, with or without prior notice. Your continued use of the Website and participation in the Event constitutes acceptance of any revised Terms. It is your responsibility to review these Terms periodically to stay informed of any changes.2. EVENT PARTICIPATION & ELIGIBILITY(a) Age RequirementYou must be at least 21 years old to participate in Adult Field Day events. Participation is strictly limited to adults due to the nature of activities and potential legal restrictions related to alcohol consumption, physical challenges, and liability concerns.A valid government-issued photo ID (such as a driver’s license, state-issued ID, military ID, or passport) is required at check-in to verify your age and identity. The name on your ID must match the name on your ticket or registration.Individuals who fail to provide proper identification or whose identification appears to be falsified, altered, or otherwise invalid will be denied entry without refund. We reserve the right to confiscate fraudulent IDs and report them to local authorities.Any participant found to have registered under false pretenses, including misrepresenting their age, will be removed from the event immediately and may be banned from future events at the discretion of Adult Field Day, LLC.Organizers reserve the right to implement additional age verification procedures if necessary, including but not limited to, requesting secondary identification or proof of age before or during the event.Certain activities, such as alcohol-related experiences or high-impact physical challenges, may require additional age verification at individual stations or check-in points within the event premises. Failure to comply with these verification steps may result in restricted access to specific event areas.Attendees are solely responsible for ensuring compliance with all local, state, and federal age restrictions related to event participation, alcohol consumption, and liability waivers.
(b) Health & Fitness DeclarationBy registering for the Event, you certify that you are in good health and physically capable of engaging in high-impact physical activities, including running, jumping, climbing, and other strenuous movements that may be required during the course of the event.You acknowledge that participation in Adult Field Day activities may require strength, stamina, balance, coordination, and endurance, and that failure to meet the necessary fitness levels may result in injury or an inability to safely participate.You further affirm that you:Have no known medical conditions that may be aggravated by physical exertion, including but not limited to:Cardiovascular disease (e.g., heart disease, high blood pressure, arrhythmia, prior strokes)Neurological conditions (e.g., epilepsy, history of seizures, concussions, multiple sclerosis)Respiratory conditions (e.g., asthma, COPD, chronic bronchitis, lung disease)Pregnancy or postnatal conditions that may impact physical activityMusculoskeletal disorders (e.g., osteoporosis, arthritis, joint instability, previous fractures, spinal issues)Metabolic disorders (e.g., diabetes, thyroid disorders) that could affect endurance or performanceHave not been advised by a physician to refrain from participating in physically demanding activities.If you have any medical condition that requires medication, assistive devices, or ongoing treatment, you agree to take full responsibility for your health and safety during the event and acknowledge that Adult Field Day, LLC and its affiliates are not responsible for providing medical accommodations or special assistance.If you experience dizziness, shortness of breath, severe fatigue, pain, heat exhaustion, dehydration, or any other adverse symptoms during the event, you agree to immediately stop participation and seek medical attention if necessary.Participants with known food allergies, medication sensitivities, or anaphylactic conditions are responsible for carrying their necessary medications, such as epinephrine injectors, and informing event staff if accommodations are needed.If you are unsure about your ability to safely participate in the event, you are strongly advised to consult with a licensed medical professional before registering and engaging in any activities.Adult Field Day, LLC reserves the right to deny participation to any individual who appears to be physically unfit, in distress, or unable to safely engage in event activities. This decision will be made at the sole discretion of event staff and on-site medical personnel, and participants may be removed from the event if safety concerns arise.By attending, you assume full responsibility for your physical well-being and waive any claims against Adult Field Day, LLC for injuries, health complications, or other medical issues that arise due to your participation in the event.All attendees acknowledge that medical emergencies are handled at the nearest available medical facility, and Adult Field Day, LLC does not guarantee the availability of on-site medical personnel or first responders. Any costs associated with medical treatment, hospitalization, or emergency transportation are the sole responsibility of the participant.Participants must stay hydrated and pace themselves during activities to avoid exhaustion, heat-related illnesses, and overexertion. Water stations will be available, and it is recommended that participants bring their own hydration supplies.(c) Prohibited ParticipantsParticipation in Adult Field Day is a privilege, and certain individuals are strictly prohibited from participating in any activities due to safety concerns, liability risks, and event policies.The following individuals are not allowed to participate in any physical activities at the event:Persons under the influence of illegal drugs, excessive alcohol, or controlled substances that impair judgment, coordination, or reaction time.Individuals with a known history of fainting, heat sensitivity, dehydration issues, or exertion-related illnesses that could pose a danger to themselves or others.Any attendee who has previously been banned from Adult Field Day due to violations of the Code of Conduct, safety concerns, or failure to comply with event policies.Persons with recent surgeries, severe physical injuries, or mobility impairments that could prevent safe participation in the event’s physical activities, unless cleared by a licensed medical professional.Individuals who have been advised by a licensed medical professional to avoid physically strenuous activities due to health risks, pre-existing conditions, or medical limitations.Any person who engages in violent, aggressive, disruptive, or inappropriate behavior before or during the event, including but not limited to harassment, verbal abuse, intimidation, or physical altercations.Any individual who fails to follow event safety protocols, refuses to comply with staff instructions, or deliberately puts themselves or others at risk.Persons experiencing visible signs of illness or distress that could compromise their own safety or the safety of others.Attendees found to be in violation of these prohibitions may be denied entry, removed from the event without refund, and permanently banned from future participation.Event staff and security personnel reserve the right to deny admission or remove any individual at their discretion if their participation is deemed unsafe or in violation of these Terms.Adult Field Day, LLC takes safety seriously and reserves the right to perform on-site assessments of attendees who appear to be impaired, unwell, or otherwise unfit for participation. Attendees who fail these assessments may be restricted from engaging in certain physical activities or removed from the event entirely.If an attendee is found to be under the influence of alcohol or controlled substances in a way that affects their ability to safely participate, they may be asked to leave designated activity areas, restricted from competitions, or removed from the event grounds at the discretion of event organizers.Participants must self-assess their own physical and mental state prior to engaging in activities and take personal responsibility for their ability to safely participate in all aspects of the event.Adult Field Day, LLC is not responsible for injuries, medical issues, or accidents resulting from attendees who fail to disclose health conditions, ignore warnings, or misrepresent their ability to participate.(d) Code of ConductAll attendees must act with respect, integrity, and sportsmanship at all times. Adult Field Day is designed to be an inclusive, enjoyable, and competitive experience, and all participants are expected to uphold the spirit of fair play, mutual respect, and community engagement.Any form of harassment, discrimination, violence, or intimidation will result in immediate ejection from the Event without refund. Harassment includes, but is not limited to:Verbal abuse, slurs, or offensive language directed at other participants, staff, or spectators.Unwanted physical contact, inappropriate gestures, or sexually suggestive behavior.Disruptive behavior that interferes with the experience of other attendees.Any form of bullying, cyberbullying, or stalking, including online harassment related to the event.Attendees must always follow all safety protocols and staff instructions. This includes but is not limited to:Adhering to designated activity rules and competition guidelines.Wearing required safety equipment when applicable.Respecting physical boundaries and not interfering with ongoing games or activities.Immediately complying with all instructions given by event staff or security personnel.Unruly, Aggressive, or Reckless Behavior:Participants must refrain from excessive force, dangerous conduct, or actions that create unnecessary risks for themselves or others.Any attendee found engaging in reckless physical contact, unsportsmanlike behavior, or endangering others will be removed from the event without refund and may be permanently banned.Engaging in behavior that leads to injuries, altercations, or damage to event property will result in immediate disciplinary action.Alcohol & Substance Use:Alcohol consumption is only permitted in designated areas and must be done responsibly.Any attendee found to be overly intoxicated, exhibiting disruptive behavior, or violating alcohol consumption policies will be removed from the event without refund.Illegal drugs, substances, or unauthorized substances are strictly prohibited. Possession, use, or distribution of such substances will result in immediate removal from the event and possible legal action.Damage to Property:Any destruction of property, vandalism, or theft will be reported to law enforcement and may result in legal action in addition to removal from the event.Attendees are financially responsible for any damage they cause to event equipment, facilities, rental spaces, or any other property associated with Adult Field Day.Respect Toward Other Participants:Participants must demonstrate good sportsmanship and fairness in all activities.Taunting, excessive trash talk, or deliberately trying to provoke another participant will not be tolerated.Any participant engaging in persistent rule violations or creating a hostile environment will be disqualified from competitions and may be removed from the event.Noise and Disruptive Conduct:Attendees are expected to keep noise levels reasonable when outside of designated competition areas.Use of offensive language, aggressive shouting, or excessive noise that disrupts ongoing activities will not be tolerated.Event Security & Staff Authority:Event security and staff have the final authority in determining violations of this Code of Conduct and enforcing disciplinary actions as necessary to ensure a safe and enjoyable experience for all participants.Security personnel are authorized to remove any participant whose actions pose a threat to others, violate event policies, or disrupt the overall experience.Failure to comply with staff or security directives will result in immediate removal from the event without refund.Disciplinary Actions for Violations:Any failure to comply with the Code of Conduct may lead to:Verbal or written warnings.Disqualification from certain activities or competitions.Immediate ejection from the event without refund.A permanent ban from future Adult Field Day events.Referral to law enforcement in cases of illegal activity or serious misconduct.By attending Adult Field Day, you acknowledge and agree to abide by this Code of Conduct. You accept that failure to comply may result in expulsion without refund and further legal or administrative consequences.
3. REGISTRATION, PAYMENTS & CANCELLATION POLICY(a) Refund PolicyRefund requests made 60 days or more before the event will be accepted, minus a $150 processing fee.Refund requests made within 60 days of the event will not be accepted.Refund requests must be submitted in writing via email to the official event contact address provided in Section 10.To request a refund, you must provide the following information:Full Name (as used in registration)Order Number (from the confirmation email)Event Date (for which the ticket was purchased)Reason for Refund, with accompanying proof where applicable (such as a doctor’s note for medical emergencies, military deployment orders, or other official documentation).Refund requests that are incomplete or lack the necessary documentation may be denied.Refunds will be processed within 21 business days upon approval.Refunds will be issued to the original payment method only. No alternative refund methods (such as cash, checks, or gift cards) will be provided.Attendees who receive refunds forfeit their right to attend the event and will be removed from all event-related communications and access lists.Adult Field Day, LLC reserves the right to deny refund requests at its sole discretion if the request does not meet the stated criteria.In cases where an event is postponed rather than canceled, attendees will have the option to transfer their ticket to the rescheduled date instead of receiving a refund.No exceptions will be made to this policy, regardless of unforeseen circumstances, including but not limited to travel disruptions, work obligations, personal scheduling conflicts, or dissatisfaction with the event experience.(b) Ticket Transfers & ResaleTickets are transferable only if requested at least 30 days before the event.Transfer requests must be submitted in writing via email to the official event contact provided in Section 10. The request must include:Full Name of the original ticket holderOrder NumberEvent DateFull Name and Contact Information of the new ticket holderWhether the transfer is to a new individual or to another event dateAll transfer requests are subject to a $99 transfer fee, which must be paid in full before the transfer is completed.Once a ticket is successfully transferred, the original ticket holder relinquishes all rights to event access, participation, and any included perks or accommodations.Ticket transfers can be made to another eligible attendee or to another event date, provided that the request meets the stated deadline and transfer conditions.The resale or unauthorized distribution of tickets is strictly prohibited. This includes:Selling tickets for more than their original purchase price (scalping)Listing tickets for sale on third-party resale websites without authorizationOffering tickets as part of an unauthorized promotion, giveaway, or raffleAny attendee found to be engaging in unauthorized ticket resale may have their ticket voided without refund and may be permanently banned from future Adult Field Day events.Adult Field Day, LLC reserves the right to reject any ticket transfer request at its sole discretion if fraud, misconduct, or abuse of the policy is suspected.If an event is postponed or rescheduled, ticket holders will have the option to transfer their ticket to the new date without incurring a transfer fee.
(c) Payment Processing & DisputesWe use Stripe and TicketSpice to securely process transactions. By making a payment through these platforms, you agree to comply with their respective terms of service and any applicable processing fees that may apply.Transactions are encrypted and processed using industry-standard security measures. However, Adult Field Day, LLC is not responsible for any third-party payment processing errors, service outages, or unauthorized transactions resulting from security breaches outside of our control.Payment Authorization: By submitting payment, you authorize Adult Field Day, LLC and its payment processing partners to charge the full amount of the transaction, including ticket fees, add-ons, and any applicable taxes.Chargebacks & Fraudulent Disputes:If you initiate a chargeback or payment dispute without valid cause, Adult Field Day, LLC reserves the right to:Permanently ban you from attending future events.Pursue legal action or collection efforts to recover losses and any fees associated with the dispute.Revoke access to the event and any associated services without refund.If you believe there was an error in your transaction, you must contact Adult Field Day, LLC before initiating a chargeback to attempt resolution.Failed or Declined Transactions:If a payment is declined, your registration is considered incomplete, and you will not be guaranteed a spot at the event.You are responsible for ensuring that your payment details are accurate and that sufficient funds are available before completing the transaction.Taxes & Service Fees:Certain transactions may be subject to local, state, or federal taxes, which will be calculated and included at checkout.Service fees charged by third-party payment processors are non-refundable unless otherwise stated.Refund Processing:If you are approved for a refund (per the Refund Policy in Section 3(a)), the funds will be returned to the original payment method within 21 business days.Refund processing times may vary based on your financial institution’s policies, and Adult Field Day, LLC is not responsible for delays caused by banks or payment providers.By completing a transaction, you acknowledge that you have read, understood, and agreed to all payment terms outlined in this section.4. ASSUMPTION OF RISK & LIABILITY WAIVER(a) Acknowledgment of RiskBy registering for and participating in Adult Field Day, you acknowledge and fully understand that the event involves inherent risks associated with physical activities, including but not limited to:Collisions, falls, and impact injuries due to running, jumping, climbing, crawling, or interacting with obstacles, inflatable structures, or other participants.Muscle strains, sprains, ligament tears, fractures, or dislocations resulting from physical exertion, improper movements, sudden impacts, or overexertion.Exposure to extreme weather conditions such as excessive heat, humidity, sun exposure, cold temperatures, wind, or rain, which could lead to heatstroke, dehydration, hypothermia, frostbite, sunburn, or other weather-related medical conditions.Risks associated with the use of event-provided equipment, including but not limited to malfunction, improper use, structural failure, or unexpected mechanical defects.Slipping, tripping, or falling on various surfaces, including grass, pavement, sand, gravel, dirt, inflatable structures, water-based obstacles, or wet and muddy terrain, which could result in minor scrapes, bruises, concussions, broken bones, or other serious injuries.Potential contact with other participants leading to accidental collisions, blunt force trauma, or unintended physical altercations that could result in cuts, bruises, sprains, concussions, or other bodily harm.The risk of sustaining head injuries, including concussions, skull fractures, or neurological complications due to falls, impacts, or improper landings from elevated surfaces.Possible exposure to insects, allergens, wildlife, or environmental elements that may cause allergic reactions, respiratory issues, infections, or other health complications.Risks associated with prolonged physical exertion, such as exhaustion, cramps, muscle failure, dizziness, fainting, cardiac distress, sudden loss of consciousness, or heat exhaustion.The possibility of encountering unsafe weather conditions, including severe storms, lightning, strong winds, or other hazardous environmental factors that may create unsafe conditions for participation.Increased risk of injury or illness due to dehydration, inadequate nutrition, improper warm-up, lack of stretching, improper footwear, or failure to follow safety instructions provided by event staff.Risk of injury due to reckless or irresponsible behavior by other participants, including pushing, tripping, excessive force, or failure to adhere to event rules and guidelines.The potential for exposure to communicable diseases, infections, or illnesses due to close contact with other participants, shared equipment, and common areas.Risks associated with improper medical response, including delays in receiving first aid, limited access to emergency medical care, or misjudgment of the severity of an injury by staff or participants.Potential property damage or loss, including personal belongings being lost, stolen, damaged, or misplaced during the event.You acknowledge that these risks may result in temporary or permanent physical injuries, disability, emotional trauma, financial burden due to medical expenses, loss of income, or in extreme cases, death, and that you are voluntarily assuming all such risks by choosing to participate.You acknowledge that despite safety precautions taken by Adult Field Day, LLC, including event design, rule enforcement, and medical support availability, absolute safety cannot be guaranteed, and unforeseen accidents, injuries, or damages may still occur.You further understand that participation is at your own discretion and risk, and it is your responsibility to ensure that you are physically prepared and capable of safely engaging in event activities.You understand that event staff and emergency responders may not be immediately available in the event of an injury and that you are responsible for monitoring your own physical condition throughout the event.If at any point during the event you feel that a particular activity presents a risk beyond your personal comfort, experience level, or ability, it is your responsibility to discontinue participation immediately to prevent injury.Adult Field Day, LLC strongly advises all participants to consult with a licensed medical professional prior to the event if they have any pre-existing medical conditions, physical limitations, underlying health concerns, recent injuries, or other factors that could affect their ability to participate safely.By attending and participating in Adult Field Day, you fully acknowledge and accept all inherent risks associated with the event, and you waive any claims against Adult Field Day, LLC related to injuries, health complications, medical expenses, lost wages, property loss, or adverse events that may arise as a result of participation.You acknowledge that participation is a personal choice, and by engaging in event activities, you take full responsibility for any injuries, complications, or financial costs that may arise, regardless of event safety measures in place.Adult Field Day, LLC is not responsible for any lost wages, medical costs, transportation expenses, personal losses, or legal claims incurred due to injury, accident, illness, property damage, or unexpected occurrences resulting from participation in the event.You understand that by signing or agreeing to this waiver during registration, you forfeit the right to pursue any legal action or claims against Adult Field Day, LLC, its owners, affiliates, sponsors, staff, vendors, or any associated entities in relation to injuries, damages, or financial losses sustained at the event.(b) No LiabilityAdult Field Day, LLC, its owners, employees, volunteers, affiliates, and sponsors shall not be held liable for any injury, loss, damage, or death resulting from participation in the Event, regardless of whether such injuries or losses arise from negligence, equipment failure, environmental factors, or actions of other participants.You assume full responsibility for all risks associated with the Event, including but not limited to injuries, illnesses, financial losses, legal claims, disability, property damage, and medical complications that may result from your participation.Adult Field Day, LLC does not guarantee the safety, condition, or reliability of any event facilities, equipment, third-party services, or environmental conditions. Participants acknowledge that all equipment, obstacles, and event-related activities are provided "as is" without warranty of any kind, express or implied.Adult Field Day, LLC is not responsible for any medical expenses, rehabilitation costs, lost wages, travel expenses, legal fees, or other financial burdens incurred as a result of participation in the Event. Any necessary medical treatment, emergency care, or extended care resulting from injuries sustained at the Event is the sole financial responsibility of the participant.In the event of an injury, accident, or other adverse event, Adult Field Day, LLC is under no obligation to provide financial assistance, reimbursement, or compensation of any kind, including but not limited to lost earnings, pain and suffering, emotional distress, or economic losses related to injuries.You acknowledge that any personal property brought to the Event is done so at your own risk, and Adult Field Day, LLC is not liable for loss, theft, damage, or destruction of any personal belongings, including but not limited to clothing, bags, electronic devices, or vehicles parked at or near the event premises. Event security measures do not guarantee protection against theft or damage to personal property.Adult Field Day, LLC and its affiliates shall not be held liable for third-party negligence, including but not limited to vendors, security personnel, medical staff, sponsors, or other service providers affiliated with the Event. Any disputes or claims arising from third-party interactions must be handled directly with the third-party entity involved.Adult Field Day, LLC assumes no liability for weather-related cancellations, rescheduled events, or modifications to the Event due to unforeseen circumstances, including but not limited to acts of God, natural disasters, public health emergencies, or government restrictions.Adult Field Day, LLC is not responsible for the mental or emotional distress of any participant arising from competitive pressures, physical exertion, social interactions, or unexpected events occurring during participation.Participants understand and accept that they are solely responsible for their own behavior, fitness levels, hydration, nutrition, and compliance with safety protocols. Any failure to follow guidelines, ignore safety warnings, or misuse event-provided equipment is at the participant’s own risk.By attending and participating in the Event, you release and waive all legal claims against Adult Field Day, LLC to the fullest extent permitted by law, including but not limited to claims of negligence, premises liability, strict liability, or implied warranty of fitness.You acknowledge that any dispute regarding injuries, damages, or liability must be handled through binding arbitration as outlined in Section 8 and that you forfeit the right to pursue any class action lawsuit or legal claim against Adult Field Day, LLC or its affiliates.By agreeing to these Terms, you voluntarily assume all risks associated with participation and waive any claims or rights to seek damages from Adult Field Day, LLC or any associated entities, recognizing that participation is entirely at your own risk.(c) Emergency Medical CareIn case of an injury, accident, or medical emergency occurring during the Event, you authorize emergency medical treatment to be provided at your own expense by on-site medical personnel, first responders, or any licensed healthcare provider.You acknowledge that Adult Field Day, LLC does not guarantee the presence of on-site medical staff and that emergency response times may vary based on event location, weather conditions, and availability of first responders.If you experience a medical emergency, you agree to follow all instructions provided by event staff and medical personnel, including evacuation or restriction from further participation if deemed necessary.You understand that medical emergencies may require transportation to the nearest medical facility, and you accept full financial responsibility for all related costs, including but not limited to ambulance fees, hospitalization, emergency procedures, diagnostic testing, prescriptions, follow-up care, and rehabilitation services.You waive any right to sue Adult Field Day, LLC for medical costs incurred during or after the Event, regardless of whether the medical condition was directly related to participation in event activities or due to pre-existing health conditions.You acknowledge that Adult Field Day, LLC assumes no liability for incorrect or delayed medical treatment, medical misdiagnosis, allergic reactions, medication errors, or other complications arising from medical interventions provided by on-site personnel, emergency responders, or off-site healthcare providers.If you have any pre-existing medical conditions, including but not limited to allergies, diabetes, asthma, or a history of cardiovascular or neurological disorders, you are solely responsible for managing your medical needs, carrying necessary medications (such as inhalers, epinephrine injectors, insulin, or other prescribed drugs), and notifying event staff if any emergency precautions should be taken on your behalf.Adult Field Day, LLC does not provide personal medical equipment, prescription medications, or specialized medical care during the Event, and it is the participant’s responsibility to bring any required assistive devices or health-related supplies.You acknowledge that all medical decisions made on-site by event staff, first responders, or medical personnel are made in good faith, and you release Adult Field Day, LLC from any liability related to medical judgments, treatment outcomes, or potential delays in receiving medical attention.If you are unable to provide consent due to unconsciousness or severe injury, you authorize event staff to contact emergency medical services and take reasonable actions in an attempt to ensure your well-being, including but not limited to contacting a designated emergency contact person, notifying event security, or arranging for transportation to a medical facility.(d) IndemnificationYou agree to indemnify, defend, and hold harmless Adult Field Day, LLC, its owners, officers, employees, agents, contractors, sponsors, affiliates, and partners from any and all claims, demands, lawsuits, liabilities, damages, losses, costs, and expenses, including reasonable attorney fees, arising from or related to:Your participation in the Event, including injuries, damages, or losses incurred by yourself or others.Any violation of these Terms of Use, event rules, or applicable laws.Your actions, behavior, or negligence during the Event, including but not limited to damage to event property, third-party injuries, or disruptive conduct.Any claims made by third parties related to your conduct at the Event.Any unauthorized use of intellectual property, brand materials, or media associated with Adult Field Day, LLC.You acknowledge that this indemnification extends to any claims related to negligence, including but not limited to the negligent acts or omissions of Adult Field Day, LLC, its employees, volunteers, sponsors, or any associated entities.This indemnification obligation shall survive the completion of the Event and remains in effect indefinitely.

In the event of any lawsuit or claim against Adult Field Day, LLC in which your actions are implicated, you agree to cooperate fully in the defense and provide any requested documentation, testimony, or evidence as needed.If Adult Field Day, LLC incurs any costs, damages, or legal fees as a result of claims related to your actions, you agree to reimburse Adult Field Day, LLC in full for all expenses incurred.This indemnification applies regardless of whether the claim arises from negligence, gross negligence, breach of contract, or any other cause of action.You agree that this clause is intended to be as broad and inclusive as permitted by law and shall be interpreted to provide the maximum protection to Adult Field Day, LLC and all related parties.
5. INTELLECTUAL PROPERTY & MEDIA RELEASE(a) Use of LikenessBy attending Adult Field Day, you grant Adult Field Day, LLC and its affiliates, sponsors, licensees, and media partners an irrevocable, perpetual, worldwide, and royalty-free right to capture, use, reproduce, modify, distribute, display, and otherwise exploit your image, likeness, name, voice, and any statements made by you in connection with the event in any and all media formats now known or hereafter developed, including but not limited to:Event photography and videographySocial media posts and marketing campaignsOnline and print advertisementsPromotional content and sponsorship materialsTelevision, radio, and streaming broadcastsDocumentary footage and corporate presentationsCommercial endorsements, brand sponsorships, and corporate partnershipsBy participating in the Event, you understand and acknowledge that:You will not receive any compensation, credit, or approval rights for the use of your likeness.Your likeness may be edited, altered, duplicated, or used in composite form with other images, graphics, text, or video content at the discretion of Adult Field Day, LLC.You have no rights to inspect, approve, or request modifications to any materials in which your likeness appears.You waive any claims based on right of publicity, privacy, defamation, false endorsement, emotional distress, or misrepresentation in connection with the use of your image, voice, or statements.Any recordings, photographs, or media captured at the Event are the sole property of Adult Field Day, LLC and may be used indefinitely without further notice or consent from you.Your likeness may be used in commercial advertisements, promotions, or sponsorship agreements that financially benefit Adult Field Day, LLC without any entitlement to compensation for such use.Your participation in group activities, public areas, or staged event segments may result in increased visibility in media coverage, including live broadcasts, press releases, or promotional recaps.Additionally, you acknowledge that other attendees, vendors, sponsors, media outlets, or third parties may take photos, record videos, or create content at the Event. Adult Field Day, LLC is not responsible for any unauthorized use of your image by third parties, including but not limited to:Social media sharing by other attendeesIndependent media coverage by journalists, bloggers, or influencersUnauthorized commercial use of event footage by third-party advertisersIf you do not wish to be included in official event media coverage, it is your responsibility to notify event staff in writing before the Event. However, opting out does not guarantee exclusion from incidental background appearances or large crowd shots where individual exclusion is impractical.By purchasing a ticket and attending the Event, you fully understand, acknowledge, and agree to the above terms regarding media usage, waiving any legal claims or rights related to the use of your likeness by Adult Field Day, LLC and its affiliates.(b) No CompensationYou waive all rights to royalties, fees, residuals, or any form of financial compensation related to the use of your likeness, image, voice, or any statements made in connection with Adult Field Day.You acknowledge that any media captured at the Event, including but not limited to photographs, videos, interviews, and social media content, may be monetized by Adult Field Day, LLC or its affiliates, sponsors, and partners without any obligation to compensate you.You understand that your participation in promotional material may indirectly contribute to the commercial success of Adult Field Day, LLC, and you waive any claim to a share of profits, advertising revenue, or sponsorship funds resulting from the use of event-related media.You further agree that even if your likeness is used for high-profile marketing campaigns, television advertisements, branded partnerships, or documentary-style productions, you will receive no financial remuneration or acknowledgment beyond your participation in the Event.You acknowledge that Adult Field Day, LLC retains full creative control over any media in which you appear and has the absolute right to modify, edit, distort, or combine your likeness with other images, graphics, or content as they see fit, without requiring your approval.You understand that even if Adult Field Day, LLC ceases operations, is acquired by another entity, or enters into licensing agreements with third parties, the rights to use your likeness remain in effect indefinitely and cannot be revoked.You waive any right to request removal, alteration, or restrictions on the use of your likeness from marketing materials, website content, printed advertisements, promotional campaigns, television or streaming content, or any other publicly distributed media.You acknowledge that other attendees, independent media organizations, influencers, or content creators may capture and distribute images or videos of you at the Event, and Adult Field Day, LLC is not responsible for third-party use of your likeness.You further agree that even in cases where your likeness is prominently featured in promotional materials, advertisements, or corporate sponsorship deals, Adult Field Day, LLC has no obligation to notify you or obtain additional permissions beyond what is outlined in these Terms.6. FORCE MAJEURE (UNFORESEEN CIRCUMSTANCES)Adult Field Day, LLC shall not be held liable for any failure or delay in performing its obligations under these Terms due to events beyond its reasonable control, including but not limited to:Natural disasters such as earthquakes, hurricanes, floods, wildfires, or other extreme weather conditions.Government actions, regulations, or restrictions, including but not limited to travel bans, public health emergencies, or martial law.Pandemics, epidemics, viral outbreaks, or other health-related emergencies declared by the World Health Organization (WHO), Centers for Disease Control and Prevention (CDC), or other regulatory agencies.Acts of terrorism, civil unrest, riots, labor strikes, or protests that significantly impact event logistics or participant safety.Power outages, cyber-attacks, technical failures, or disruptions in internet or telecommunications services that prevent ticketing, event coordination, or essential operations.Venue cancellations, lease terminations, or failures by third-party vendors, sponsors, or service providers to fulfill their commitments.In the event that Adult Field Day, LLC is unable to hold the Event as scheduled due to force majeure circumstances, the following policies shall apply:Postponement: The Event may be rescheduled for a later date, and all purchased tickets will be automatically transferred to the new date.Event Cancellation: If rescheduling is not possible, attendees may be offered alternative event credits, but no refunds will be issued under any circumstances.Partial Performance: If the Event is partially affected by force majeure (e.g., certain activities or locations are unavailable), attendees shall not be entitled to refunds or compensation for any modifications.Adult Field Day, LLC reserves the right to modify, relocate, or reformat the Event in response to force majeure events, including changing the venue, date, or structure of the activities.Attendees acknowledge and accept that force majeure events are outside the control of Adult Field Day, LLC and waive any claims, disputes, or legal actions arising from cancellations, postponements, or modifications due to unforeseen circumstances.By purchasing a ticket and attending the Event, you fully accept the risks associated with unpredictable circumstances and agree that Adult Field Day, LLC shall not be held liable for any damages, financial losses, or inconveniences caused by force majeure.8. DISPUTE RESOLUTION & GOVERNING LAWThese Terms shall be governed by and construed in accordance with the laws of the State of Utah and the State of California, without regard to conflict of law principles that would require the application of any other jurisdiction's laws.Any disputes, claims, or controversies arising out of or relating to these Terms, your participation in Adult Field Day, or any interactions with Adult Field Day, LLC shall be exclusively resolved through binding arbitration.(a) Arbitration AgreementBy agreeing to these Terms, you waive your right to bring any claims in court and agree to resolve all disputes through arbitration, which shall be administered by a recognized arbitration organization under its applicable rules.The arbitration proceedings shall take place in Salt Lake City, Utah or another location mutually agreed upon by both parties.Arbitration shall be conducted by a single neutral arbitrator with expertise in contract and liability law.The arbitrator’s decision shall be final and binding, and judgment upon the award may be entered in any court having jurisdiction.The arbitration shall be conducted in English and in accordance with the Federal Arbitration Act (FAA) and applicable state arbitration laws.(b) Class Action WaiverYou agree that any arbitration or legal action shall be conducted only on an individual basis, and you expressly waive your right to bring, join, or participate in any class action, class arbitration, or representative claim.No arbitrator shall have the authority to consolidate claims or preside over any form of a collective or class proceeding.(c) Exception for Small Claims & Injunctive ReliefEither party may bring an individual claim in small claims court if the claim qualifies under the applicable small claims court limits.Adult Field Day, LLC reserves the right to seek injunctive or equitable relief in a court of law to prevent actual or threatened violations of intellectual property rights, unauthorized use of trademarks, or breaches of confidentiality obligations.(d) Governing Law & VenueThese Terms shall be governed and interpreted in accordance with the laws of the State of Utah and State of California, excluding their conflict of law principles.Any legal action seeking to enforce an arbitration award, injunctive relief, or a small claims matter shall be filed exclusively in the state or federal courts located in Salt Lake City, Utah You agree to submit to the personal jurisdiction of such courts and waive any objection

It is your responsibility to review these Terms periodically to stay informed of any updates.Continued use of the Website, purchase of event tickets, or participation in Adult Field Day after modifications have been made constitutes acceptance of the revised Terms.If you do not agree to any changes made to these Terms, you must cease participation in the Event and refrain from further use of the Website.Adult Field Day, LLC is not responsible for any perceived or actual failure to notify users of updates to these Terms.
